Dear Vadim Lvovich!

The legal service of the "Association of Dry Cleaning and Laundry Enterprises" has reviewed your request and informs you of the following on the merits of the issue raised in it.

According to clauses 5.1-5.2 of the "Intersectoral Rules on Occupational Safety when using chemicals" (POT R M-004-97), approved by By Resolution No. 44 of the Ministry of Health and Social Development of the Russian Federation dated September 17, 1997, all chemicals supplied to consumers must be labeled, the content of which must comply with the requirements of GOST 3885-73 "Reagents and especially pure substances. Rules of acceptance, sampling, packing, packaging, labeling, transportation and storage" (see paragraphs 5.1-5.6).

According to clause 5.1 of GOST 3885-73, a label with the REACHIM trademark or the manufacturer's trademark (if any) must be affixed to each unit of consumer packaging, on which Recommended specify, in particular, the name of the manufacturer. Mandatory requirements for the indication on the label of information about the location of the manufacturer in Russian in the specified standard are also not provided.

In addition, in the current Code of Administrative Offences of the Russian Federation dated December 30, 2001, No. 195-FZ (hereinafter referred to as the Administrative Code of the Russian Federation) administrative liability for the absence of the specified information on the product is not provided for either the supplier company or the buyer company, which uses the appropriate preparations in the provision of dry cleaning and laundry services.

In connection with the above, we recommend that in the future we find out from customers which inspection authorities and on what basis make claims against dry cleaning companies and laundries regarding the absence of specified information on the supplied goods, and send the information received to the Association for analysis and appropriate action on the facts of unjustified regulations.
